Louboutin Loses Red Sole Case, CFDA Releases Design Manifesto

The CFDA (Council of Fashion Designers of America) has created the design manifesto poster below as reminder of the importance of idea and design protection.

Could this have something to do with the recent lawsuit lost by Christian Louboutin against Yves Saint Laurent for using a red sole on a YSL shoe? The court ruled against Louboutin, sending the fashion world into a fury.

In his ruling, judge Victor Marrero wrote “Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin is unlikely to be able to prove that its red outsole brand is entitled to trademark protection, even if it has gained enough public recognition in the market to have acquired secondary meaning.” Read more about the ruling and reactions from Louboutin and YSL here.

Louboutin isn’t giving up without a fight, and it’s clear that the case won’t end with this ruling. By the looks of this poster, much of the fashion industry will be behind him every step of the way.
